Welcome to the Petisco Brazuca website (the “Website”). By accessing our Website, placing an order, requesting catering services, purchasing any product, creating an account, or otherwise using any portion of our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as our Privacy Policy, Shipping & Delivery Policy, Refund Policy, and any other policies incorporated herein by reference.

If you do not agree with these Terms, you must immediately discontinue use of our Website and Services.

Petisco Brazuca reserves the right to modify these Terms at any time without prior notice. Any modifications become effective immediately upon posting on our Website. Continued use of the Services constitutes acceptance of the revised Terms.

SECTION 1 — ELIGIBILITY

By using our Services, you represent and warrant that:

SECTION 3 — DAILY PRODUCTION & DELIVERY CAPACITY

Petisco Brazuca specializes in freshly prepared, handcrafted Brazilian food. To preserve the quality of our products and maintain our service standards, our daily production and delivery capacity is intentionally limited.

Our online ordering platform accepts orders based on availability; however, order placement does not guarantee fulfillment on the requested delivery date or time.

Petisco Brazuca currently maintains a maximum operational capacity of fifteen (15) deliveries per calendar day.

If customer demand exceeds our production capacity, delivery capacity, staffing levels, kitchen availability, transportation resources, weather conditions, ingredient availability, equipment limitations, or any other operational constraint, Petisco Brazuca reserves the unrestricted right, at its sole discretion, to:

 

• • postpone any delivery;
  • modify delivery windows;
  • reschedule any order;
  • divide an order into multiple deliveries;
  • refuse additional orders;
  • partially fulfill an order;
  • cancel any order;
  • issue a full refund to the original payment method.

Customers expressly acknowledge and agree that these operational limitations are essential to maintaining food quality and customer safety.

Accordingly, Petisco Brazuca shall not be liable for any indirect, incidental, consequential, punitive, special, business, emotional, or economic damages arising from any rescheduling, delay, refusal, modification, or cancellation of an order due to operational capacity limitations.

No compensation beyond the refund of amounts actually paid shall be owed under these circumstances.

SECTION 4 — CATERING, CORPORATE & LARGE ORDERS

Petisco Brazuca proudly provides catering services for private events, corporate functions, festivals, weddings, celebrations, and other special occasions.

Because catering orders require advance planning, staffing, ingredient procurement, scheduling, and food preparation, additional terms apply to these orders.

Large orders, catering services, and corporate orders may require:

 

• • advance notice;
  • a minimum purchase amount;
  • a non-refundable deposit;
  • written confirmation;
  • final guest count confirmation;
  • payment in full prior to production.

 

Unless otherwise agreed in writing, Petisco Brazuca reserves the right to decline any catering or large-volume order that exceeds our available production capacity.

Any requested modifications after an order has entered production may be declined at our sole discretion.

Failure to provide timely event information, venue access, delivery instructions, or required permits may result in delays for which Petisco Brazuca shall not be responsible.

SECTION 5 — PRODUCT AVAILABILITY

All menu items are subject to availability.

Certain products may be seasonal, offered in limited quantities, or discontinued without prior notice.

Petisco Brazuca reserves the right to:

 

• • discontinue any product;
  • limit quantities;
  • substitute unavailable ingredients;
  • remove menu items;
  • modify recipes;
  • update product offerings at any time.

 

If a purchased product becomes unavailable before preparation begins, we may:

 

• • substitute the product with one of equal or greater value;
  • contact the customer for approval;
  • issue a partial refund; or
  • cancel the affected portion of the order.

 

SECTION 6 — HANDCRAFTED FOOD DISCLAIMER

All Petisco Brazuca products are handcrafted and prepared fresh.

Because every product is individually prepared, customers acknowledge that reasonable variations may naturally occur, including but not limited to:

 

• • appearance;
  • shape;
  • color;
  • texture;
  • seasoning;
  • garnish;
  • weight;
  • portion size;
  • presentation.

 

These natural variations are inherent characteristics of handmade food and shall not constitute defects, non-conformities, or grounds for refunds or replacement.

Product photographs displayed on our Website, menus, social media accounts, advertisements, or marketing materials are for illustrative purposes only and may differ from the final product served.

SECTION 7 — INGREDIENTS & SUBSTITUTIONS

Petisco Brazuca prepares food using fresh ingredients sourced from multiple suppliers.

Ingredient availability may vary due to:

 

• • seasonality;
  • supplier shortages;
  • import restrictions;
  • transportation disruptions;
  • market conditions;
  • quality standards.

 

Accordingly, Petisco Brazuca reserves the right to substitute ingredients with comparable ingredients of equal or greater quality whenever reasonably necessary.

Whenever practical, customers will be notified before significant substitutions are made.

Customers with allergies, dietary restrictions, or religious dietary requirements are solely responsible for informing Petisco Brazuca before placing an order.

SECTION 8 — PRICING

All prices displayed on our Website are listed in U.S. Dollars unless otherwise indicated.

Prices may change at any time without prior notice.

Petisco Brazuca reserves the right to correct:

 

• • pricing errors;
  • typographical mistakes;
  • incorrect promotions;
  • calculation errors;
  • tax calculation errors.

 

If an order has been placed using an incorrect price resulting from a system error or human error, Petisco Brazuca reserves the right to cancel the order and issue a full refund.

Taxes, delivery fees, gratuities, service charges, and other applicable fees may be added during checkout.

SECTION 9 — PAYMENTS

Payment must be successfully authorized before production begins.

Petisco Brazuca accepts payment methods made available through our Website.

SECTION 10 — DELIVERY SERVICES

Delivery times provided through our Website are estimates only.

Actual delivery times may vary due to:

  • delivery partner availability;
  • customer availability;
  • unforeseen operational circumstances.

 

Petisco Brazuca does not guarantee delivery at any exact time unless expressly agreed in writing.

Once an order has been delivered to the address provided by the customer, responsibility for the food immediately transfers to the customer.

Customers are responsible for ensuring that someone is available to receive the order.

If no recipient is available upon delivery, Petisco Brazuca may, at its sole discretion:

 

• • leave the order in a reasonably safe location;
  • contact the customer for further instructions;
  • return the order;
  • cancel the delivery.

 

Additional delivery fees may apply for redelivery attempts.

Petisco Brazuca shall not be responsible for any deterioration in food quality resulting from delayed acceptance of the delivery by the customer.

SECTION 11 — INCORRECT DELIVERY INFORMATION

Customers are solely responsible for providing complete and accurate delivery information.

If an incorrect address, apartment number, access code, telephone number, or delivery instructions are provided, Petisco Brazuca shall not be responsible for any resulting delays, failed deliveries, or additional costs.

If a second delivery attempt is requested due to incorrect customer information, additional delivery charges may apply.

No refund shall be required where delivery cannot be completed because of inaccurate information provided by the customer.

SECTION 12 — PERISHABLE FOOD PRODUCTS

All food products sold by Petisco Brazuca are freshly prepared and are considered perishable.

To preserve quality and food safety, customers are encouraged to consume their order as soon as reasonably possible after delivery or pickup.

Once an order has been delivered or picked up, Petisco Brazuca cannot control how the food is stored, transported, reheated, handled, or consumed.

Accordingly, Petisco Brazuca shall not be responsible for any deterioration in quality, taste, texture, freshness, appearance, or safety resulting from improper storage, delayed consumption, mishandling, improper reheating, or any other circumstances occurring after delivery or pickup.

Customers assume full responsibility for proper refrigeration, storage, transportation, and consumption of all products after receipt.

SECTION 13 — FOOD SAFETY

Petisco Brazuca is committed to preparing food in accordance with applicable food safety regulations and industry best practices.

Despite our commitment to maintaining strict food safety procedures, customers acknowledge that food products are natural products and may vary in characteristics.

Customers are responsible for:

 

• • properly storing food after delivery;
  • consuming products before spoilage;
  • following any heating or refrigeration instructions;
  • disposing of food that appears unsafe due to improper storage after delivery.

 

Petisco Brazuca shall not be responsible for food safety issues arising after the customer has taken possession of the order.

SECTION 14 — ALLERGEN DISCLAIMER

Petisco Brazuca prepares food in facilities where common food allergens may be present.

Our products may contain or come into contact with, including through shared preparation areas or equipment:

 

• • Milk
  • Eggs
  • Wheat
  • Soy
  • Peanuts
  • Tree Nuts
  • Fish
  • Shellfish
  • Sesame
  • Mustard
  • Other common allergens

 

Although we strive to minimize cross-contact, we cannot guarantee that any product is completely free of allergens.

Customers with food allergies, dietary restrictions, medical conditions, or food sensitivities must notify Petisco Brazuca before placing an order.

Customers acknowledge that they purchase and consume our products at their own risk.

Petisco Brazuca disclaims any liability arising from allergic reactions or dietary restrictions that were not disclosed before the order was prepared.

SECTION 15 — FOOD INFORMATION DISCLAIMER

Descriptions of menu items, ingredient lists, nutritional information, caloric values, dietary labels, or health-related information provided on our Website are offered solely for informational purposes.

Such information should not be interpreted as medical, nutritional, or dietary advice.

Customers with medical conditions, food allergies, dietary restrictions, or other health concerns should consult an appropriate healthcare professional before consuming any product offered by Petisco Brazuca.

SECTION 16 — ORDER CANCELLATIONS

Because all Petisco Brazuca products are freshly prepared to order, cancellation rights are limited.

Customers may request cancellation only before food preparation has begun.

Once preparation has started, orders become non-cancelable and non-refundable.

Petisco Brazuca reserves the sole right to determine whether food preparation has commenced.

For catering orders, corporate events, and large-volume orders, separate cancellation deadlines may apply under the applicable Catering Agreement.

Petisco Brazuca reserves the right to cancel any order at any time due to:

 

• • operational limitations;
  • staffing shortages;
  • ingredient availability;
  • weather conditions;
  • suspected fraud;
  • payment verification issues;
  • safety concerns;
  • circumstances beyond our reasonable control.

 

If Petisco Brazuca cancels an order before preparation begins, customers will receive a full refund of amounts actually paid.

SECTION 17 — REFUNDS

Refund requests are evaluated individually.

Refunds will not be issued solely because:

 

• • a customer changes their mind;
  • food preferences differ;
  • appearance differs slightly from promotional images;
  • natural product variations occur;
  • delivery estimates were exceeded by reasonable operational delays;
  • food was improperly stored after delivery;
  • the customer entered an incorrect delivery address;
  • the customer failed to receive the delivery.

 

Refunds may be issued only when required by applicable law or when Petisco Brazuca determines, in its sole discretion, that a refund is appropriate.

Where approved, refunds shall be limited to the purchase price actually paid for the affected product or order.

No refund shall include compensation for:

 

• • inconvenience;
  • travel expenses;
  • lost profits;
  • emotional distress;
  • business interruption;
  • consequential damages.

 

SECTION 18 — CUSTOMER RESPONSIBILITIES

By placing an order, customers agree to:

  • ensure someone is available to receive deliveries;
  • inspect products promptly upon receipt;
  • notify Petisco Brazuca of legitimate order issues within twenty-four (24) hours of delivery;

Failure to satisfy these responsibilities may limit or eliminate any available remedies.

SECTION 19 — CUSTOMER CONDUCT

Petisco Brazuca is committed to providing a respectful environment for both customers and employees.

Customers agree not to engage in:

 

• • abusive language;
  • harassment;
  • threats;
  • discrimination;
  • intimidation;
  • fraudulent conduct;
  • chargeback abuse;
  • false complaints;
  • attempts to obtain free products through deception;
  • interference with our employees or delivery personnel.

 

Petisco Brazuca reserves the right, at its sole discretion, to:

 

• • refuse service;
  • cancel pending orders;
  • suspend customer accounts;
  • permanently prohibit future purchases;
  • deny participation in promotions;
  • report unlawful conduct to law enforcement authorities where appropriate.

 

No customer has a guaranteed right to future service from Petisco Brazuca.

SECTION 20 — REVIEWS, FEEDBACK & USER SUBMISSIONS

Petisco Brazuca welcomes customer feedback and reviews regarding our products and services.

By submitting any review, photograph, video, testimonial, comment, suggestion, social media post, tag, or other content (“User Content”) to Petisco Brazuca, whether through our Website, email, Google Reviews, Yelp, Facebook, Instagram, TikTok, or any other platform, you represent and warrant that:

 

• • you own or have the legal right to submit such content;
  • your submission does not infringe upon the rights of any third party;
  • your submission is truthful and not intentionally misleading.

 

You hereby grant Petisco Brazuca a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable license to use, reproduce, publish, distribute, modify, display, translate, adapt, and otherwise utilize such User Content for marketing, advertising, promotional, educational, or business purposes in any media now known or later developed.

Petisco Brazuca has no obligation to publish, maintain, or compensate any User Content.

We reserve the right to remove any User Content that we determine, in our sole discretion, to be unlawful, abusive, defamatory, fraudulent, misleading, or otherwise inappropriate.

SECTION 21 — PHOTOGRAPHY & MARKETING CONSENT

Petisco Brazuca may photograph or record its food, beverage presentations, catering displays, and event setups for marketing purposes.

Unless otherwise agreed in writing before the event, customers acknowledge that photographs or videos focusing primarily on Petisco Brazuca’s products, equipment, displays, branding, or catering setup may be used on our Website, social media platforms, advertising, and promotional materials.

Petisco Brazuca will not intentionally identify individuals in marketing materials without appropriate authorization where required by applicable law.

Customers hosting private events may request in writing that no photographs or videos be taken for marketing purposes. Such requests must be received before the event begins.

SECTION 22 — INTELLECTUAL PROPERTY

All content available through the Petisco Brazuca Website and Services is the exclusive property of Petisco Brazuca or its licensors.

This includes, without limitation:

• the Petisco Brazuca® name;
• logos;
• trademarks;
• service marks;
• recipes;
• menu descriptions;
• product names;
• food presentations;
• packaging designs;
• branding;
• website design;
• graphics;
• photographs;
• videos;
• written content;
• promotional materials;
• software;
• source code;
• marketing campaigns;
• business methods.

Nothing contained on this Website grants any license or ownership interest in any intellectual property rights.

No content may be copied, reproduced, modified, distributed, sold, republished, displayed, reverse engineered, or commercially exploited without prior written authorization from Petisco Brazuca.

Unauthorized use may result in civil and criminal penalties under applicable intellectual property laws.

If a chargeback is initiated without first providing Petisco Brazuca a reasonable opportunity to investigate and resolve the matter, we reserve the right to:

• suspend or terminate customer accounts;
• refuse future orders;
• pursue any legal remedies available under applicable law.

IN NO EVENT SHALL PETISCO BRAZUCA’S TOTAL AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY THE CUSTOMER FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions, Petisco Brazuca’s liability shall be limited to the maximum extent permitted by applicable law.

SECTION 28 — NO RESALE POLICY

Unless expressly authorized in writing by Petisco Brazuca, all products sold through our Website are intended solely for personal consumption or the specific event for which they were purchased.

Customers may not:

• resell our food;
• relabel our products;
• represent themselves as authorized distributors;
• use our trademarks in connection with resale;
• commercially exploit our products without prior written authorization.

Petisco Brazuca reserves the right to refuse future orders from any customer engaged in unauthorized resale or commercial distribution.

During any Force Majeure event, Petisco Brazuca may suspend, postpone, modify, or cancel orders without liability beyond refunding amounts actually paid for any undelivered products.

SECTION 31 — MANDATORY DISPUTE RESOLUTION

Petisco Brazuca values customer satisfaction and encourages customers to contact us directly regarding any concern before pursuing formal legal action.

Except where prohibited by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms, your use of the Website, or any purchase made through our Services shall first be submitted to good-faith informal negotiations.

If the dispute cannot be resolved through informal discussions within thirty (30) days, either party may pursue the remedies available under applicable law, subject to the provisions of these Terms.

If Petisco Brazuca relocates or changes its principal place of business, this provision shall automatically apply to the governing law of the new principal jurisdiction unless otherwise required by law.

SECTION 34 — ELECTRONIC COMMUNICATIONS

By using our Website or placing an order, you consent to receive electronic communications from Petisco Brazuca, including order confirmations, invoices, receipts, customer service communications, policy updates, and other notices related to your transactions.

You agree that electronic communications satisfy any legal requirement that such communications be in writing.
